Terms of Service

These Terms of Service (“Terms”) govern your use of BERFO, a service built by Berforia LLC (“BERFO,” “we,” “us”). By creating an account or using BERFO, you agree to these Terms. BERFO is currently available in the United States only.

Eligibility

You must be 13 years of age or older to create a BERFO account or use the service. By signing up, you represent and warrant that you meet this minimum age requirement. We do not currently collect separate parental consent for users between 13 and 17 — our stance is that the 13+ age floor itself is the eligibility bar for using BERFO. If we learn that an account was created by someone under 13, or that age was misrepresented at signup, we reserve the right to suspend or terminate that account.

Your account

You’re responsible for keeping your account credentials and recovery methods secure. BERFO uses end-to-end encryption for your content — see our Privacy Policy for how account recovery works. Because of how this encryption is designed, we may not be able to recover your content for you if you lose access through methods outside what we offer.

Acceptable use

You agree to use BERFO only for its intended purpose — a private, personal tool for keeping up with the people in your life. You agree not to:

• Use BERFO to harass, stalk, or harm another person.
• Attempt to access another user’s account or encrypted content without authorization.
• Reverse-engineer, decompile, or attempt to bypass BERFO’s security or encryption.
• Use BERFO in any way that violates applicable law, or to interact with other people in a manner that violates applicable age-of-consent or protection laws.
• Use automated means (bots, scrapers) to access BERFO outside of the app itself.

You represent that you will not misuse BERFO to interact inappropriately with people under applicable minimum ages, and that your use of the service is at your own risk and subject to applicable law. BERFO itself is a private relationship tracking and coordination tool — it is not, and is not intended to be used as, a platform for adult content.

Subscriptions (BERFO Plus)

BERFO Plus is an optional paid subscription that auto-renews through Apple’s standard in-app subscription mechanism. You can cancel at any time through your Apple ID subscription settings; cancellation takes effect at the end of the current billing period. Payments are processed by Apple, and — except as required by Apple’s own refund policies or applicable law — payments are non-refundable.

Intellectual property

BERFO and Berforia LLC retain all rights, title, and interest in and to the BERFO app and service, including its design, branding, and underlying technology. You retain all rights to the content you create in BERFO — your notes, reminders, and relationship details belong to you.

Disclaimer of warranties

BERFO is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that BERFO will be uninterrupted, error-free, or completely secure.

Limitation of liability

To the fullest extent permitted by law, Berforia LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of BERFO. [TODO: attorney to specify liability cap.]

Changes to these terms

We may update these Terms from time to time. If we make material changes, we’ll provide notice through the app or by email before they take effect. Continuing to use BERFO after changes take effect means you accept the updated Terms.
